This privacy policy (this "Privacy Policy") applies to the Web sites owned and operated by Chronus Corporation, a Washington corporation (the "Company"), located at mentor.chronus.com (the "Home Site") and all sub-domain sites created through or via the Home Site (each a "Sub-Domain Site," and together with the Home Site, the "Site"). Note that the Site is made available to you by the "Site Sponsor" who has entered into an agreement with the Company. This Policy is designed to tell you how we collect and use personal information (as defined below) so you can make an informed decision about using the Site. Please read this Privacy Policy and the Company’s Terms of Service (into which this Privacy Policy is incorporated) (the "Terms of Service") before using the Site or submitting any personal information to us. By using the Site, you represent that you are 13 years old or older and you consent to the information collection and use practices described herein. We reserve the right to change or modify the provisions of this Privacy Policy at any time by posting a revised privacy policy on the Site and indicating on this Privacy Policy the date it was last updated. Your use of the Site following the posting of such changes or revised statement shall constitute your acceptance of any such changes and modifications. We encourage you to review the Privacy Policy whenever you visit the Site to determine if any changes have been made and to make sure that you understand how any personal information you provide will be used.

WHAT IS PERSONAL INFORMATION

As used herein, the term "personal information" generally means information that specifically identifies an individual (such as user's name, e-mail address, date of birth, city, or country) or that is associated with an identifiable person (such as demographic information or information about a person's activities when such information is linked to personally identifying information). Personal information also does not include "aggregate" information, which is data we collect about the use of the Site or categories of Site users, from which any personal information has been removed. For example, information that forty-seven percent (47%) of the Site's registered users identify themselves as male is aggregate information. We collect aggregate data for a number of purposes, including helping us understand trends and user needs so that we can better consider new publications, products, and services, and tailor existing publications, products and services to user desires. This Privacy Policy in no way limits or restricts our collection of aggregate information.

WHAT PERSONAL INFORMATION DO WE COLLECT?

Personal information may be collected in a number of ways when you visit the Site or use the various services and activities available on the Site. At several places on the Site, we may collect certain information you voluntarily provide to us which may contain personal information. For example, if you register for Services on the Site, we will collect your name, email address, date of birth, and city and country, and we may collect other demographic information that you provide. Personal information may also be collected if you provide such information in your profile or in connection with leaving comments, inviting a supporter, sending an email or message to another user or participating in any interactive forums or features on the Site.

In addition, from time to time we may collect demographic, contact, or other personal or demographic information you provide in connection with your participation in surveys, promotional offers, forums, and other interactive areas of the Site.

When you visit the Site, some information is also automatically collected through the use of request logging, such as your computer's Internet Protocol (IP) address, your computer's operating system, the browser type, the address of a referring web site and your activity on the Site. We use this information for purposes such as analyzing trends, administering the Site, improving customer service, diagnosing problems with our servers, tracking user movement, and gathering broad demographic information for aggregate use. We may also automatically collect certain information through the use of "cookies." Cookies are small data files that are stored on a user's hard drive at the request of a Web site to enable the site to recognize users who have previously visited them and retain certain information such as customer preferences and history. If we combine cookies with or link them to any of the personally identifying information, we would treat this information as personal information. If you wish to block, erase, or be warned of cookies, please refer to your browser instructions or help screen to learn about these functions. However, if your browser is set not to accept cookies or if a user rejects a cookie, you will not be able to sign in to your Chronus Mentor account and will not be able to access certain Site features or services. The Company may also collect and analyze from visitors and users certain information regarding the use of the Site and the Services and the Site activity. Information collected may include but is not limited to the Site traffic volume, frequency of visits, type and time of transactions, type of browser and operating system, IP address, requested URL, referring URL, etc. This information is logged to help diagnose technical problems, administer the Site, and improve the quality and types of Services delivered. In addition, we use this information to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site and to inform advertisers of such information as well as the number of users that have been exposed to, or clicked on, their advertising banners. In an effort to improve the usability and customer experience of the Site and the Services, the Company may use tools to record, track, and analyze user information (including personal information but not passwords) impacting usage (e.g., tracking mouseclicks). Also, we may occasionally access your personal information for the purposes of resolving technical issues or customer service issues; provided, however, that none of this personal information will be shared with third parties except to the extent necessary to resolve technical issues and to comply with applicable laws.

You acknowledge and agree that you are aware that the Company or Site Sponsor’s Administrator of its Chronus program may access otherwise private Mentor-Mentee areas on the Site if the Company or Site Sponsor or an Administrator of Site Sponsor’s Chronus program has a reasonable basis to prevent material abuse or potential material liability.

We may also use third parties to record usage information to collect, track, and analyze non-personally identifiable usage and volume statistical information from users, such as the user's browser type, operating system, browsing behavior, and demographic information.

Usage and Disclosure

In general, we use personal information we collect to facilitate your use of the Site, to provide you with information, products, and services you request, to inform you about other information, events, promotions, products, or services we think will be of interest to you, to administer and assist us with the operation of the Site and of our business, and for the purpose for which the information was provided. For example, we may use the information we collect:

  • to send you a welcoming email and to contact you about your use of the Site, such as for administrative purposes or to provide you with customer service;

  • to provide you with the services, products or information you requested and to complete any transactions in connection therewith;

  • to respond to your emails, submissions, comments, requests or complaints;

  • to contact you about our or a third party's services, products, activities, special events or offers and for other marketing, informational, product development and promotional purposes;

  • to notify contest winners;

  • to request feedback and to enable us to develop, customize and improve the Site and our information and services; and

WHAT PERSONAL INFORMATION DO WE SHARE WITH THIRD PARTIES?

We may share your personal or business information as described below:

Affiliated Businesses We Do Not Control: We anticipate that we may become affiliated with a variety of businesses and work closely with them. In certain situations, these businesses may operate stores at the Site, sell items to you through the Site or offer you products or services that may be of interest to you. In other situations, the Company may provide services, or sell products jointly with affiliated businesses. You can easily recognize when an affiliated business is associated with a particular opportunity or transaction, and we will share user information that is related to such opportunity or transaction with that affiliated business.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Examples include sending email, analyzing data, and providing user services. Without your permission, the Company's agents do not have any right to use personal information we share with them beyond what is necessary to assist us.

Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if the Company, or substantially all of its assets or capital stock were acquired, or in the event that the Company goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of the Company may continue to use your information as set forth in this Privacy Policy.

Protection of the Company and Others: We may release personal and business information when we believe in good faith that release is necessary to comply with law; enforce or apply our Terms of Service, this Privacy Policy, and other agreements; or protect the rights, property, or safety of the Company, our employees, our users, or others. This includes, without limitation, exchanging information with other companies and organizations for fraud protection.

With Your Consent: Except as set forth above, you will be notified when your personally identifiable individual information may be shared with third parties, and will be given the option to prevent the sharing of this information.

We do not sell, share, or rent any personal information to others in ways different from what is disclosed in this Privacy Policy without first obtaining your consent, although we may provide aggregate information or other non personal information to third parties without your authorization. In the event that we engage or partner with third party vendors, consultants, or other service providers in connection with the operation of the Site and our business ("Service Providers"), we may share personal information with such Service Providers who need access to such information to carry out their work for us. In addition, we may offer various features through a third party service provider. You should also note that personal information that you post to public areas of the Site or information you have marked to share with other users, may become publicly available. For example, information you post in your profile, forums, blogs, mentor content, or any other interactive areas, or other information that is provided for the purpose of being shared may be made publicly available and can potentially be viewed by anyone. Please be aware, however, that although we endeavor to use commercially reasonable efforts to implement this restriction, no security measure is perfect or impenetrable, and therefore, we cannot guarantee that this information will not be available to others. We recommend you be cautious in giving out personal information to others in public online forums. Your posting to such public areas of the Site constitutes your consent to share such information publicly. In addition, people who you designate as a coach will receive notifications of your updates. PLEASE DO NOT POST ON THE SITE OR ANY OTHER AREAS ANY PERSONAL INFORMATION THAT YOU EXPECT TO KEEP PRIVATE.

We also may disclose personal information when we are required to or we believe it is appropriate to comply with the law (e.g., a lawful subpoena, warrant, or court order); to enforce or apply this privacy policy or our other policies or agreements; to initiate, render, bill, and collect for amounts owed to us; to protect our or our customers' rights, property or safety; to protect our customers from fraudulent, abusive, or unlawful use of our Site; or if we believe that an emergency involving the danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of personal information. In addition, information about our customers, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personally identifiable information could be transferred to third parties as one of the business assets of the Company.

Please be aware that although we may participate in or utilize such other sites, we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave the Site and to read the privacy policies of any Web site that collects personally identifiable information. Similarly, if you entered the Site through another Web site, we are also not responsible for the privacy practices of that site, and you should review the privacy policy of the originating site before providing any personal information to that site. This Privacy Policy applies solely to information collected by us.

WHAT STEPS DO WE TAKE TO PROTECT YOUR INFORMATION ONLINE?

We endeavor to secure your personal information from unauthorized access, use, or disclosure by putting into place physical, electronic, and managerial procedures to safeguard the information we collect through the Site. For example, your account information is accessible online only through the use of a password. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable. To protect the confidentiality of your personal information, you must keep your password confidential and not disclose it to any other person. We will send you news and product and service updates, unless you "opt out" of receiving such emails by so indicating by changing your account settings through the "edit profile" section of the website. Please note, however, that as long as you maintain an account, you may not "opt out" of receiving service or account-related emails from the Company.

HOW CAN YOU CORRECT AND UPDATE YOUR PERSONAL INFORMATION OR OBTAIN ADDITIONAL INFORMATION

However, please note that in certain circumstances, we may not, or may not be able to, remove or change certain information, even in the event an account is closed. For example, we may retain certain information, for a certain period of time, and we also may retain and continue to display any information you provided in connection with a Profile or a blog or other interactive forum. Customer Surveys

The Company may periodically conduct both business and individual customer surveys. We encourage our customers to participate in these surveys because they provide us with important information that helps us to improve the types of services we offer and how we provide them to you. Your personal information and responses will remain strictly confidential, even if a third party conducts the survey. Participation in our customer surveys is voluntary.

We take the information we receive from individuals responding to our customer surveys and aggregate it with the responses from other customers to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our services to you, and to develop new services and products. This aggregated, non-personally-identifying information may be shared with third parties.

SUPREMACY

In the event of any conflict of terms and conditions between this Privacy Policy and the terms of any agreement between the Site Sponsor and its users, the term and conditions of this Privacy Policy will prevail.
